New Real Estate Agency Licensing Law in Montenegro

Montenegro is gradually bringing its real estate market closer to clear European standards. In the summer of 2025, the country adopted the Law on Mediation in the Sale and Lease of Real Estate — Zakon o posredovanju u prometu i zakupu nepokretnosti.

The idea behind the law is simple: the market should be served by registered agencies and professionals who are responsible to their clients, not by random intermediaries.

In the past, almost anyone could work in real estate: a person without an office, without a contract, without experience, and without clear responsibility. For buyers, this created risks: unchecked documents, nice promises, hidden problems with the property, and no proper support after the transaction.

Now agencies must be entered in the official register of intermediaries, and agents must complete professional training and pass an exam. The law also introduces requirements for an office, client contracts, liability insurance, and property advertising.

For buyers, this is good news. The market is becoming more mature: less chaos, more transparency, and more responsibility. Of course, changes like this do not work overnight. The years 2026–2028 will likely be a transition period, during which the system will gradually be adjusted: the register, exams, control mechanisms, and new working standards.

These changes matter to everyone buying property in Montenegro: an apartment, house, villa, land plot, rental property, or any other real estate asset. It is not enough to simply choose an attractive option. Buyers need to understand the documents, cadastre records, legal status of the property, payment procedure, and possible risks.
